What’s Allowed in Emergency Order #12?

A new public health order—Emergency Order #12—goes into effect at 12:01am on January 13. This order is very similar to Order #11. We’ve outlined the changes below:

Indoor gatheringsAllows indoor gatherings of up to 10 people (not including employees), with physical distancing and face coverings. A Mass Gathering is a planned event such as a concert, festival, meeting, training, conference, performance, show, sporting event, or party.No change
Outdoor gatheringsAllows outdoor gatherings of up to 25 people (not including employees), with physical distancing. You must be physically distanced from anyone you don’t live with.

Allows outdoor gatherings of up to 50 people (not including employees), with physical distancing. You must be physically distanced from anyone you don’t live with.

Drive-in activities may now also offer outdoor seating, as long as it complies with gathering limits.

Sports
  • Courts and fields can still be open open. Physical distancing of six (6) feet is required.
  • All sports activities are gatherings and must follow the gathering requirements: allowed indoors with up to 10 people who do not live together, with physical distancing and face coverings; allowed outdoors with up to 25 people who do not live together, with physical distancing.
  • Games and competitions are allowed for low risk sports if the gathering requirements outlined above are followed. Low risk sports are those that can be done individually or with physical distancing.
  • Games and competitions are not allowed between teams for medium and high-risk sports. However, games and competitions within teams would be allowed, if the events are modified to ensure six (6) feet physical distancing is maintained at all times, and the gathering limits outlined above are followed.
  • Indoor gyms, courts, swimming pools can operate at 50% capacity. Any scheduled activities are limited to 10 or fewer people who do not live together, with physical distancing and face coverings (face coverings are not required in pools). Six (6) feet physical distancing is maintained at all times.
Physical distancing between individuals not from the same household or living unit must be maintained to the greatest extent possible for low risk sports. (Previously required physical distancing of six (6) feet at all times. Physical distancing of six (6) feet is still required at all times for medium and high-risk sports.)
Gyms & Fitness Classes
  • Gyms are still allowed to open to 50% capacity.
  • Saunas and steam rooms are still closed.
  • Group exercise classes may only be offered if physical distancing can be maintained at all times and there is no person-to-person contact. Indoor group classes are limited to 10 or fewer people (see mass gathering guidelines above).
  • Outdoor classes are limited to 25 people who do not live together, with physical distancing.

Face coverings

Face coverings are required for most people 5 years of age and older when in an enclosed space with people you don't live with. This includes inside buildings and vehicles where people you don’t live with are present. It also includes when standing in a line, when waiting for food and drink outside at a restaurant, and in a park structure (e.g., pavilion).

Face coverings are strongly recommended outdoors when it is not possible to physically distance.

Childcare

Individual groups or classrooms may not contain more than 15 children.

There should be no interaction or contact between individual groups or classrooms, and there should be physical distancing to the greatest extent possible for youth ages five (5) and above.

Schools

Students and staff must wear a face covering, if possible, inside the building and on school buses. Social distancing also must be practiced inside classrooms, on buses and on school grounds.

Businesses

Restaurants and Taverns

Restaurants

  • Indoor dine-in capacity limited to 25% of approved seating capacity levels, with physical distancing between parties. Individual tables must all be from the same household or living unit.
  • Outdoor seating is allowed with physical distancing. Customers must wear face coverings when not actively eating and drinking.
  • Must have written cleaning and hygiene policies in place.

Taverns

  • Indoor seating at taverns is not allowed; customers may enter taverns only to order, pick-up, and pay for food or beverage.
  • Outdoor seating is allowed with physical distancing. Customers must wear face coverings when not actively eating and drinking.
  • Must have written cleaning and hygiene policies in place.
No change, except to determine whether an establishment is a restaurant or a tavern, gross receipts for the period July 1, 2020 to December 31, 2020 will be considered. (Previous period in Order #11 was July 1, 2019 to June 30, 2020.)
Religious and Spiritual Entities
  • Religious worship services are exempt from gathering requirements.
  • These entities must have written cleaning and hygiene policies in place.
  • Events outside of a religious service or practice, like picnics or staff meetings, are allowed inside, but only with 10 or fewer attendees who do not live together, and with face coverings and physical distancing. These events outside are limited to 25 people who are not from the same household.
No change, except outdoor events as described at left are now limited to 50 people who are not from the same household.
