What’s Allowed in Emergency Order #13?

A new public health order—Emergency Order #13—goes into effect at 12:01am on February 10, 2021. There are quite a few changes with this Order. Below is a high-level overview of the changes. Please see the Order for full details.

Indoor gatherings |
Allows indoor gatherings of up to 10 people (not including employees), with physical distancing and face coverings. A Mass Gathering is a planned event such as a concert, festival, meeting, training, conference, performance, show, sporting event, or party. |
A Gathering inside where food or drink is offered or provided is limited to 25 individuals or less, not including employees. A Gathering inside where food or drink is not offered or provided is limited to 50 individuals or less, not including employees. Individuals must maintain 6 feet physical distancing, face coverings must be worn. |
Outdoor gatherings |
Allows outdoor gatherings of up to 50 people (not including employees), with physical distancing. You must be physically distanced from anyone you don’t live with. |
A Gathering outside where food or drink is offered or provided is limited to 100 individuals or less, not including employees. A Gathering outside where food or drink is not offered or provided is limited to 150 individuals or less, not including employees. Individuals must maintain 6 feet physical distancing. Face coverings required if more than 50 individuals at the Gathering. |
Face coverings |
Face coverings are required for most people 5 years of age and older when indoors with people you don't live with. This includes inside buildings and vehicles where people you don’t live with are present. It also includes when standing in a line, when waiting for food and drink outside at a restaurant, and in a park structure (e.g., pavilion). Face coverings are strongly recommended outdoors when it is not possible to physically distance. |
The requirements for types of face coverings was updated to be reflective of CDC guidance (e.g., cloth face coverings with two or more layers). Certain things are not allowed, such as, bandanas, single layer neck gaiters and ski masks. Face coverings are now required:

Sports |
Physical distancing between individuals not from the same household or living unit must be maintained to the greatest extent possible for low risk sports. Games and competitions are allowed for low risk sports with physical distancing maintained to the greatest extent possible and in compliance with gathering limits. Physical distancing is still required at all times for medium and high-risk sports. |
6 feet physical distancing is required at all times between individuals not from the same household or living unit except when individuals are actively participating in the sport. All individuals who are not actively participating in the sport must maintain 6 feet physical distancing at all times. All sports that cannot maintain physical distancing at all times are limited to 25 individuals indoors, not including employees. All sports that cannot maintain physical distancing at all times are limited to 100 individuals outdoors, not including employees. All sports must have a hygiene policy, cleaning policy, and protective measure policy. Organizers must document receipt, acknowledgement, or training on these policies. |
Gyms & Fitness Classes |

All activities that are sports must follow the sport requirements. All other requirements for gyms & fitness classes remain the same, including: Group exercise classes may only be offered if 6 feet physical distancing can be maintained at all times and there is no person-to-person contact. Group exercises classes are considered Gatherings and must comply with gathering requirements (listed above). |
Childcare & Youth Settings |
Individual groups or classrooms may not contain more than 15 children. There should be no interaction or contact between individual groups or classrooms, and there should be physical distancing to the greatest extent possible. |
Size limits for regulated child care and four-year old kindergarten (4k) were removed. Youth settings must follow gathering requirements (listed above). |
Schools |
Students and staff must wear a face covering, if possible, inside the building and on school buses. Social distancing also must be practiced inside classrooms, on buses and on school grounds. We issued guidance for schools on December 14. See our news release for more information. |

Colleges and universities may set their own practices but may not open group living quarters without “strict policies that ensure safe living conditions.” |
